It is illegal to remove the CAT at the FEDERAL level. 


What you were told is because you don't need an
emissions test they will not CATCH you without it.. 
Just because you do something that your unlikely to
get in trouble for does not make it "legal".

However, your mechanic broke the law by removing it.
