currently being used only for off-road driving. This is considered
tampering. Tampering provisions pertain to all self-propelled motor
vehicles orginally designed for transporting persons or property on a
street or highway."
As you can see, the EPA doesn't care if it's used off road or not.. If the vehicle was originally designed for street use and came with a cat, removing it is considered illegal even if that vehicle will never be driven on the street again.
