Flynt released the tapes into the media, not to the prosecution or defense.

"Flynt has run a political campaign before. He launched a brief campaign for
president against Ronald Reagan in 1983. He is also well-known in the
courts, having served time in federal prison time in 1984 for not revealing
the source of FBI undercover tapes he released that showed footage from the
drug sting against former automaker John DeLorean." From an unrelated CNN

I'd suggest renting or buying "The People vs. Larry Flynt" It's a good movie
on it's own and includes some of the DeLorean footage, the court battle that
the movie is centered around. Even if you don't learn anything, it's still
worth the 2hrs in my opinion.
